It's just sort of a given in the industry, at least locally. It's hourly for everything except for trial. They miss a whole day of work to come in and so they reason that only a flat fee will cover the losses. |

It's usually a bit of a struggle to find plaintiff-side experts so when they green-light the case I usually want to get them onboard without niggling over terms of their retainer, which might spoil the anticipated very close relationship over the course of successive months.
Also, with those retainer contracts, sword and shield if you know what I mean. |
