If I lie and say your wife is sleeping around and you kill her, am I then liable for murder? I think not, on the same logic as above — we reasonably expect people to behave reasonably (or at least that is the legal fiction).
Also, I'm troubled by this defamation case on, essentially, civil libertarian grounds — I think Jones is being punished for having stupid and unpopular opinions, and I do not like the precedent. |

and before you go on about defamation being a novel concept: there has always been a distinction between opinion speech and factual speech. an opinion about a factual event that you did not witness should be protected from defamation so long as it is not knowingly false. if jones said "i was in sandy hook and saw the crisis actors" then i think he should be liable. but him saying "i think it was a hoax and that they're lying" is just an opinion that he has not (to my knowledge) expressed any personal knowledge of. |
