Not knowing what Article II is seems far more egregious that not knowing civil procedure, since it defines the powers (and duties) of the President of the United States and sits at the foundation of our entire government. Is this really the best you could do?

I sure knew it. Art 1 is the legislature because that's where the authors of the Constitution assumed they were going end up working.

Separately, how the fuck does anyone not know what Art. 1 Sec. 8 does? How do you pass the bar? That section should be burned into everyv lawyer's brain, and it begins with "Article 1," so there's a hint for you.

i've passed multiple bars and i had no idea what Art. 1 Sec. 8 does nor do i remember ever needing to learn it. every lawyer should know that IP is federal law but i doubt very many (aside from IP lawyers) would known which article, let alone which section, it is contained.

It’s a simple assumption if you think about how laws work in this country

First someone has to write the law—that’s the legislature! Let’s make that the first article. That’s what happens first, after all.

Okay, we have a law but who implements and enforces it? Maybe a POTUS and cabinet? Okay that’s article 2

Oh no! Our 180 law is actually causing a lot of confusion and people have disagreement about it. We need people who can resolve these controversies. Maybe make that the third article

When I worked for the government it would have been unfathomable to engage any lawyer or judge who didn't know the basic architecture of the US government. How do you not know where your own authority is established? Or the authority (if any) of the opposing party? How do analyze any piece of legislation without knowing what's in Article I?

I said district court. The way I earn my salary is by knowing things like, when some suit for injunctive relief gets filed against the state government, that they can, in fact, get prospective injunctive (but not monetary) relief against state officers for violations of federal law under Ex Parte Young, but the Supreme Court's decision in Pennhurst v. Halderman means that any pendent claims based on violation of state law have to be dismissed for lack of jurisdiction based on Eleventh Amendment immunity.

Knowing a ton of rules of enormous practical importance like that are what separates a knowledgeable federal practitioner from a noob. Most of what is really important is not covered or certainly emphasized in law school con law classes- you just have to learn it on the job.

Originalism is a doctrine of _constitutional_ interpretation. Textualism is the equivalent doctrine, but for statutes. (Original public meaning is the correct sub-doctrine for each.) You're right about 3), though.

textualism refers to looking only at the text to interpret at statute. originalism refers to divining the original intent of the drafters of legislation, which can include referring to sources outside the text of the legislation. originalism doesn't refer only to constitutional interpretation and can be used for any legal text.

why are you still being a yosemite sam fuming faggot about this? all i did was address a comment that asserted originalism only applies to the constitution, which i believe is incorrect.

it's always referred to as judicial activism. i don't remember hearing purposivism before

The purposive approach (sometimes referred to as purposivism,[1] purposive construction,[2] purposive interpretation,[3] or the modern principle in construction)[4] is an approach to statutory and constitutional interpretation under which common law courts interpret an enactment (a statute, part of a statute, or a clause of a constitution) within the context of the law's purpose.

If she had forgotten that one but got II right I don't think it would be newsworthy. Not knowing where the POTUS derives his authority is next level shit.

how are they any different? do you think she doesn't know potus derives his power from the constitution because she didn't recall which article is about potus? how is that any different than knowing the constitution contains the method for it to be amended without recalling specifically which article it's in?

Some people might wonder what the POTUS actually does, or can actually do. Or any executive branch agency for that matter. I remember libs thinking Trump would do all kinds shit the POTUS can't do. I remember people talking about a vaccine mandate at one point. Whatever man. You're right, it's nothing

nah that one was a dumb gotcha. she's like 47-48 according to wikipedia so there's never been a constitutional amendment passed in her adult life, and it's not something that would be likely to come before a judge anyways. not knowing article II is pretty egregious though

No, but I'd guess a whole bunch of Article II nominees know about Article II.

idk what that is. one second circuit negress did not know whether parties could waive subject matter jurisdiction.

(kennedy tried to play gotcha with a trump nominee by asking him whether he was familiar with the rooker-feldman abstention doctrine, so he is not always on the ball with these.)

Part of what you see here is a generational gap. the older generation is used to memorizing shit. The newer generation has been able to search for everything in their work the past 20 years.

I'd be more worried if someone didn't understand some application of the law but who really cares that someone doesn't know section references?

But she’s 48 not 28

Also she doesn’t really look it but she is a “black” woman and is probably being groomed for the 9th Circuit

Everyone should know that military appropriations lapse after 2 years so that the president can't go on a rampage unchecked forever. It's little things like that that make it impossible for us to have a real military dictatorship. That's not in Article II but that's kinda the point. How can anyone tell you we have a system of checks and balances if they can't name one?
