But it has an even bigger hole factually. The heart of the underlying crime - the reason that the case is being charged as a felony - is that Trump supposedly engaged in a "conspiracy" to win election.
BUT TRUMP IS NOT BEING CHARGED FOR ANYTHING THAT HAPPENED IN 2016. He's charged for misclassifying the repayments he made to Cohen in 2017.
And in 2017, at the time of the payments to Cohen, Donald Trump had already beaten Hillary Clinton. He was president of the United States. He didn’t need to engage in a conspiracy to win the 2016 election. He COULD NOT engage in a conspiracy to win the 2016 election, not without a time-travel machine, which is not mentioned in the indictment.

That's correct - but the state is not charging Trump with anything related to the payments. The crime is only related to his alleged mis-classfication of the payments on his internal records.
So how could that misclassification be in furtherance of an election he already won?

(i) Assuming everything is true that Trump paid Cohen money for (a) the reimbursement, (b) Cohen's taxes, and (c) Cohen's fees, why is fraud for Trump to characterize all of this as "legal fees" on his internal documents of a private company?
(ii) Who was harmed by this? You say Cohen got to claim it as income rather than reimbursement - but that just means Trump paid more money in taxes. Isn't that good for the government?
(iii) In what way was the C&K ever illegal? It's only a felony because they're alleging it was part of some conspiracy to steal the election. But all the alleged illegal aspects occured after the election?
(iv) Michael Cohen is Trump's attorney and structured the deal. He could easily have structured this transaction legally. Why is Trump being charged criminally for Cohen's alleged incompetence?

First degree falsifying business records may be predicated on the falsification being intended either to further another crime or to conceal it. So they could prove an unlawful campaign contribution and that the falsification of the business record was done with the intent to conceal the campaign finance violation.
However, it seems like they aren't even focusing on the campaign finance violation now, and are trying to say the predicate crime is conspiracy to promote or prevent election:
"Any two or more persons who conspire to promote or prevent the election of any person to a public office by unlawful means and which conspiracy is acted upon by one or more of the parties thereto, shall be guilty of a misdemeanor."
I'm not sure how this theory works, but it seems circular.

Look what they did to Michael Cohen. They basically walked over attorney client privilege, went hunting for a crime, found mortgage application he lied on (even though he paid the loan in full - seem familiar?).
Then they saw his wife signed the mortgage application, so they go to him and say "plead guilty to the campaign finance charges or we'll throw your wife in jail."
And then these evil, corrupt people point to this and say "Clearly it was an illegal campaign finance contribution Michael Cohen plead guilty to it!"
It's moral corruption at the highest level.
