I signed up for that piece-of-crap website a couple of years ago. I never agreed to their bullshit terms and conditions; the terms and conditions were (or at least now are) under a small SEPARATE link at the bottom of their website. Even though I didn't read those terms, I paid enough attention in Contracts to know that I'm not bound to an unconscionable agreement, which this is. Assuming the separate statement of terms and conditions is considered part of the contract, the terms and conditions are ludicrously unfair. At the time I signed up, the website said I agreed to a one-year membership - PERIOD! I never authorized them to withdraw funds from my account for the rest of my life! That's BULLSHIT.

The agreement is procedurally unconscionable for at least two reasons.
First, Ancestry.com enjoyed unequal bargaining power. I was a 0L at the time of the agreement and lacked the education and sophistation of a giant corporation and its biglaw attorneys. Worse, the contract was necessarily offered on a take-it-or-leave basis with NO negotiation.
Second, Ancestry.com unfairly surprised me by hiding the term in a separate agreement that I couldn't have known was connected to the contract unless I clicked on it.
The agreement is also substantively unconscionable because it shifts all the risk to me and enables Ancestry.com to withdraw funds from my account for the rest of my life unless I follow a cumbersome and byzantine process for terminating my account.

"2. FEES AND PAYMENTS
2.1 Continuous Service Membership. Subscription membership in the Service is on a continuous service basis. This means that once you have become a subscribing member, your subscription will be automatically renewed and your billing choice will be charged based on the subscription program (annual, quarterly, monthly, etc.) you have chosen. I'll attach the agreement as Exhibit A, depose someone from Ancestry.com and attach a depo excerpt as Exhibit B, and attach responses to requests for admissions as Exhibit C.

I have to cancel two days in advance. It's obviously too late for the last membership year. But I don't see why it's not worth suing when a company that size - it's owned by the Church of Latter Day Saints - is unlikely to contest a few hundred bucks.

if you value your time, you would just accept your mistake (not canceling before the new subscription period), eat the fee and remember not to make that mistake again.

I did. They can only stop payment on the last transaction. I'd need a lawyer to handle the other claims. I will be filing a complaint in the federal district court for the district of Utah shortly.

Also, did you tell your bank that this was a fraudulent transfer? This isn't something you changed your mind about; rather, this is the equivalent of someone stealing your card, and they have a duty to investigate it as such.

so you gave them your card information not realizing that they'd charge you in the future with it? either you're brilliant flame or the dumbest person to ever step foot on xoxo

This is a bullshit question. I just bought a book on amazon.com. Does that mean I authorized the bookseller to keep withdrawing money from my account for the rest of my life?

You can at least call your bank and have future charges blocked, and even try to have recent charges (within 90 days) reversed. Classmates.com tried this shit on me a few years back.
