Just bullshit your way through. And not flame throw in 3’” height boosters with your sexy muscle it’ll compress to like 1.5-2. You’re handsome as fuck and the judge will side with you no matter what.

I think they didn’t believe the da had proven the element that he intended to deprive the victim of the property at the time he used force. It was kind of a kooky case where my client got into an argument with his friend, pushed her and then grabbed her phone and threw her phone. He then goes and picks up the phone and takes off with it. I argued was that he was just pissed at her and trying to get her to leave because she kept yapping- he didn’t intend to rob her at that point. If he has formed the intent to steal it at that point then why did he throw it? What kind of robber damages the property before stealing it? Clients story on the stand was that he never took off with the phone and just left it there when he tossed it but she was too high to realize it
They convicted him of the lesser of misdemeanor theft though (didn’t matter because he got no additional time). We beat the Best da offer by 8 months and avoided a strike. No trial tax this time luckily . Win win for client
He got 2 years on the evading (mid term) and 8 months consecutive for 3 additional felony drug cases. 2 year 8 months total. The evading was terrible…he was going at least 115 and not on the freeway

you're a great poster and seem like a good man on top of that. feel free to ignore this if the question is too rude - i have friends who are pd's and i largely avoid asking them questions like this.
do you think society is better off with this guy not in prison? is that too general and abstract to be a fair question wrt day to day operations of the criminal defense system?
i totally hear you that the facts described may not be robbery. but it's hard to believe that guy will turn his life around

He’ll still do the 2 year 8 months prison time. Do I think he’ll turn his life around? Well, he’s 40, so there’s a chance he may slow down and take less risks (like going 115 to evade cops) as he ages. Most of his crimes before this were petty drug charges
If he doesn’t clean up his act and quit doing fentanyl and meth, the judges and das here will give him longer prison sentences the next time . A lot of These kind of guys are constantly in and out jail…some of them eventually clean up and break out of the cycle (or od and die)

Dejected and in panicked disbelief. Their face is always the best part because losing is MUCH more embarrassing for them than it is for us. My client and I were very nervous about what the jury would do on that charge so we were extremely relieved

what's the charge if he just grabs the phone and steals it, without using force? arguably that's what he did after the throw is the way i'm thinking about it

Petty theft (misdemeanor because the value of the phone was only 400). Thats the lesser charge they found him guilty
Of. It didn’t really make a difference in his sentence here. Robbery would have been a Strike, which would have serious consequences if he was convicted of any other felonies in the future
